Visa Categories

H-1B Visa

  • Type: Non-immigrant visa for specialty workers.
  • Duration: Initially 3 years, extendable up to 6 years.
  • Sponsorship: The hiring district will be the sponsor.
  • Requirements: Job must qualify under the visa program, possession of a U.S. bachelor’s degree or equivalent, and a cap on the annual number of visas.
  • No Numerical Cap: (Public schools and other non-profit educational institutions are generally exempt from the H-1B visa cap.)

J-1 Visa

  • Type: Non-immigrant visa for teachers, scholars, or exchange visitors.
  • Duration: 3 years and can be extended for another two years, valid until the end of the exchange program.
  • Sponsorship: Sponsors will vary depending on which company the district has partnerships with. Requirements: Good reputation, minimum 3 years teaching experience, bachelor’s degree or equivalent, currently employed as a teacher, and meet the destination state’s requirements.
  • No Numerical Cap: Unlike the H-1B visa, which has an annual cap on the number of visas issued, the J-1 visa does not have a cap on the number of visas for teachers or other exchange visitors. Therefore, public schools (which are eligible to sponsor teachers on J-1 visas) are not subject to a numerical cap.

Host School Eligibility

  • Host schools must be affiliated with an accredited public, charter, or private K-12 school system in the United States. They are required to offer full-time academic programs and be accredited by the relevant academic authority in their jurisdiction. Additionally, host schools must demonstrate financial capability to provide a full-time teaching position to prospective teachers.

  • Host schools are obligated to offer any H-1B or J-1 exchange teacher a salary and benefits comparable to those of U.S. teachers with similar qualifications and experience. All job offers must be for a full academic year, with a maximum duration of up to three years for the H-1B visa and the potential for a two-year extension for the J-1 program.

  • Furthermore, host schools must facilitate necessary yearly cross-cultural activities, which are a significant component of the H-1B or J-1 program within the school and the broader community. It is also essential for host schools to assign a mentor to teachers at the beginning of their H-1B or J-1 program.
